Order of Business to include: Presentation  Rebecca Swanson, Executive Director Montgomery County Redevelopment Authority on RACP Grant Funding and Conditions created by the required cooperation agreement when Grant is filed by others. This Public Workshop Meeting includes the Administration & Finance, Building, Zoning & Revitalization, Public Safety and Public Works Committees and will include orders of business that may be brought forward to these Committees. The meeting agenda will be posted here on the Borough website no less then 24 hours prior to the meeting.

Borough Hall will be Closed on Monday, February 20th  in Observance of President’s Day – Borough Hall will re-open for Administrative Business Tuesday, February 21st, at 9:00 AM.

Order of Business to include: Presentation 101 York Road – Minor Land Development Application to Borough Council –  Proposed Oil Change Business to move in to former Glanzmann Service Center building/property at 101 York Road. Wednesday, February 22th, 2023. 7:00 PM – Borough Council Hearing / Meeting
In person at Borough Hall and virtual via ZOOM platform, livestream Facebook.
Order of Business to include: Public Hearing before Borough Council to consider the legal adoption of the Subdivision Land Development Ordinance (SALDO). The Hearing was required to be advertised twice in a newspaper of general circulation, those dates are/were February 7th and 14th. The SALDO re-write was a huge undertaking by the Planning Commission and was than reviewed by the County Planning Commission, Borough Engineer, Borough Solicitor, Borough Zoning Officer and presented before Council at the Building, Zoning & Revitalization Committee. The Document is approximately 77 pages long and is available for Public Inspection at Borough Hall and at the County Law Library. It had not be revised in over fifty years and was in need of this comprehensive update of the rules & regulations governing development and improvements to properties falling under the definition of Sub-Division Land Development within the Borough. The review and re-write process of the Borough SALDO has been a two year process. This Public Hearing is an Official Court Hearing and it allows for Public Comment during this process for consideration of approval. Meeting to include: Resolution of support to submit Montco 2040 grant application for RT 611 / York Road – Safety Plan  and will include other orders of business that may be brought forward. Monday, February 27th, 2023. 7:00 PM – Zoning Hearing Board – In person at Borough Hall and virtual via ZOOM platform, livestream Facebook. (Hearing – Continuance from Thursday, January 26th)

Additional and Project Specific Information will be provided on the Borough website on the land development page and at Borough Hall.
This Project was initially submitted under a ‘Conditional Use Application’ and has been before the JB Planning Commission where the apartment building use was Recommended for Approval along with the reduction of parking to Borough Council with the recommendation for the proposed developer to meet with the adjacent property owners to discuss the project and possible revisions that could address their concerns.

The Conditional Use Application for the ‘Apartment Building Use’ then went to a Public Hearing on October 26th before Borough Council. At the conclusion of the Conditional Use Hearing on November 30th 2022, Borough Council Approved the ‘Apartment Building Use’. At that the Conditional Use Hearing the Applicant also requested that Borough Council consider an on-site parking reduction as per Code Section 181-74. Relief of the required on-site parking spaces shown in Table 5 of the Jenkintown Parking Standards was requested under Section 181-74 and for the specific exceptions listed in code section 181-74 (There are four exceptions listed including: A. The use is located within 750 feet walking distance from a public parking facility which has available parking spaces for the subject property. B. On-street parking is provided directly in front of or directly behind the building, are two of those four exceptions.) The on-site parking spot reduction request was considered and granted per 181-74 by Borough Council. (on-site reduction would now equal 3.5 on-site parking spots)  

  • The next step in the process for the property owner would be Zoning.

Prior to the ZHB Hearing taking place the Developer and his Representatives met with a group of adjacent Property Owners and their Representative as recommended by the JB Planning Commission. Two concessions/accommodations were made that the Borough was made aware of to try and lessen concerns voiced at that meeting including the reduction in the number of apartments from 26 to 23 and the reduction in mass of the proposed third floor, shifting the proposed third floor five feet further from the rear property line shared with the Leedom street properties.

The Applicant filed the Zoning Hearing Board Application for a Hearing before the ZHB to seek the following Zoning relief.

  1. A variance under Section 181-421 of the Zoning Code so as to permit twenty-three (23) apartment units.
  2. An interpretation or determination that the proposed roof of the building is in keeping with the character of adjacent buildings. In the alternative, a variance under Section 181-46 B.(4) so as to permit a flat roof with a green area.
  3. A variance under Section 181-42D so as to permit a reduction in the side yard setback requirement of 10 feet to accommodate the structural steel supporting the proposed second and third floor addition.
  4. A variance under Section 181-46A. (1) so as to permit existing sidewalk to remain, which is less than 8′ in some areas.
  5. An interpretation that the existing dimensional non-conformities noted on the matrix included on the Zoning Plans dated December- 22, -2022 prepared by CANNO design, submitted with this Application, may be continued. In the alternative, a variance so as to permit all such existing non-conformities to be continued.

The first Zoning Hearing Board Hearing took place at Borough Hall at 7:00 PM on Thursday, January 26th and was continued to Monday, February 27th at 7:00 PM at Borough Hall.
At the Conclusion of the Zoning Hearings if the Applicant is granted the Zoning relief sought and/or if the applicant decides to continue with the project.

  • The next step in the process would be the Land Development Process.

During that process the Land Development Application and Plans would be submitted to the Borough Manager, Borough Engineer, Borough Planning Commission, County Planning Commission, Borough Council, Borough Fire Marshal, Borough Solicitor for reviews and input. Once the application was deemed complete.
 The Applicant would then appear before the Borough Planning Commission and finally before Borough Council to address the review letters and request approval of Preliminary and Final Land Development. If Borough Council approves Land Development, the Applicant would post an escrow and payment bond guarantee that would ensure the completion of the work as shown on the approved plans.

  • The next step in the process is obtaining UCC Construction permits.

When the Construction plans have been reviewed and approved by the Borough Building Code Official, the permits can be issued once all Regulatory agencies (MCCD, PaDep) approvals have been obtained.
